The False Claims Act (31 U.S.C. Sections 3729-33) allows a private individual or "whistleblower", with knowledge of past or present fraud on the federal government, to sue on behalf of the government to recover stiff civil penalties and triple damages. The person bringing the suit is formally known as the "Relator." If the suit is successful, it not only stops the dishonest conduct, but also deters similar conduct by others. The whistleblowers generally receive anywhere from 15 to 30 percent of the federal governments total recovery. In fiscal year 2005, the federal government collected $1.4 billion in settlements and judgments and paid out over $166 millions dollars to Whistleblowers. Relator's awards since 1986 have reached almost $1 Billion.
The False Claims Act also prohibits an employer from harassing or retaliating against an employee for attempting to uncover or report fraud on the federal government. If retaliation by an employer does occur, the Relator may be awarded "all relief necessary to make the employee whole," including reinstatement, back pay, two times the amount of back pay, litigation costs, and attorney fees.
